Long <br />Division Dueclor <br />We have reviewed your request for termination of Stipulation No. 9 <br />which was included with the Technical Revision No. 23 adequacy <br />response letter dated February 14, 1996. Stipulation No. 9 is <br />hereby terminated. <br />This termination can occur because the geotechnical stability <br />information required by rule 4.03.1 was submitted and approved with <br />Technical Revision No. 22. The submittal addresses stability <br />issues associated with the haul road in its current configuration. <br />Rule 4.03.7 (haul road reclamation) does not require specific <br />reclamation stability analyses; however, Energy Fuels Coal, Inc. is <br />strongly encouraged to assess the overall stability of any road <br />reclamation backfill work prior to, and after actual reclamation. <br />Be aware that failure of backfill and grading work associated with <br />road reclamation may lead to enforcement action. <br />Thank you for your continued cooperation. <br />mental Protection Specialist <br />
