MANAGEMENT <br />RECE~~N~~ <br />h1AR ; ~ 2005 <br />Oivisian Gf Minerzls ano Geelom• <br />On February 1, 2005, the DMG issued a notice of violation to Bowie Resources, LLC, <br />for failure to provide a geotechnical analysis that demonstrates the factor of safety of <br />the in place and proposed coal mine waste bank no. 2 is 1.5 or greater using site <br />specific characteristics (moist unit weight) and strength parameters of cohesion and <br />angle of internal friction from coal processing waste material that have been placed on <br />the coal mine waste bank no. 2. <br />The steps necessary to abate the violation are to provide a geotechnical analysis that <br />demonstrates the factor of safety of the in-place and proposed coal mine waste bank <br />no. 2 is 1.5 or greater. The required geotechnical analysis is enclosed to abate the <br />violation. <br />The results of the stability study are explained on page 13 of Volume IX. In summary, <br />the slope inclinations will have to be flattened to assure the pile attains a factor of safety <br />of 1.5. ' <br />Amended pages 3, 13 and the Geotechnical Engineering Study are enclosed for the <br />referenced technical revision adequacy response.
