Applications for 7-e{r (10) Acres or Less. <br />1. Proposed operations whose total surface disturbance related to <br />the mining operation will affect ten (10) acres or less of land <br />niay submit an application modified in such {vat's as set forth irr <br />'the following subsections: F-11-b, 12-b and 11-2 of section III. <br />2. Sur (ace disturbance shall mean die area of l;md from which any <br /> amount of overburden has been removed, or upon which any amount <br /> of overburden has heen deposited, or both, m{d shall include, but <br /> not be limited to: on-site private ways, roads, and railroad lines; <br /> lv{d excavations; development drill sites or workings; refuse <br /> banks or sli++i1 piles; evaporation or settling ponds; work, storage <br /> or {vaste discharge areas; areas in rvlriclr structures, facilities, <br /> eyuilament, machines, tools, or other materials or prolrerty wlriCJ{ <br /> result from or are used in such operations, are situated. <br />• 3. Subsequent enlargement of affected lmrd by the same or affiliated <br /> operator shall result in the operation becoming subject to all <br /> d{e requirements for an operation in excess of ten (10) acres. <br />4. The staff shall make arr inspection of the proposed permit area <br /> a{rd report to the Board. If, in the Opi{llOll of the Board, tlrc <br /> proposed open mining operation would have signi[icant long term <br /> adverse effects on die proposed permit area, the Board shall re- <br /> yuire tl{c full detailed application form as if the operation were <br /> v{ excess of ten (10) acres. <br />S. The term "open mining <br />operations" shall include all phases oC all activities employed <br />in the miming and reclvnatio{r processes, It shall include all <br />affected lands as defined in subsection I-B-4. <br />c. 2.
