In the cast oC conrnercial, recreational, icidustt-ial or resi- <br />dential post-mining uses, the operator shall demonstrate to the <br />satisfaction of the Board that such uses will take place within <br />a rc;csonahlc time. In judging this matter, the Board may con- <br />sider such factors as approv;ils of relevant public agencies, <br />danonstr:itien oC private financial capability, plvuied develop- <br />meat schedule, specific design for development, assurance of in- <br />vestment necessary for public facilities, and demonstrated tom- <br />. patibility with adjate~~t land uses. If the operator cannot so <br />demonstrate to the satisfaction of the Board, he shall amend his <br />reclamation plan to achieve the reclamation goals of these <br />rules. <br />7. If tlic reclaimed land area is to be titilizcd for raiigc purposes, <br />the Board may require incorporation of a grazing program after <br />.vegetation establishment to gauge stand tolera~ice to grazing <br />pressure. <br />8. In the case of permits for sand, gravel, and quarry aggregate <br />operations, tl~e operator shall complete leis ol~ec-ations and begin <br />reclamation within five (5) years after the initial permit is <br />issued. All reclamation shall lie completed within Ucree (3) <br />years after tlic date the operator adivses tlic Board that rcclama- <br />• lion has begun. <br />9.. Por all other operations, land stabilization and reclamation <br />shall he coir~~lcted within tlirce (3) years after the date the <br />operator advises the Board that reclamation has commenced. <br />10, In the event the mine area is subjected to severe drought that <br />prcvecits establishment of vegetation acid for which tlccre is <br />meteorlogical and/or evidence of crop failures that supports the <br />contention of drought limitation to reclamation success, the <br />three (3) year terns for completion oC the reclamation shall be <br />extended one }•car for each growing season during which draught <br />conditions exist that prevent the establistunent of vegetation. <br />E.
