SCUI'L' ANU 1'URPOSL• <br />A. Scope and Purpose: <br />1. The purpose of these rules and regulations (hereinafter referred <br />to as " nrles") is to provide, during the Ininrng process ;urd af[er• <br />mining operations have been completed, for the reclamation of <br />land srrlijected to surface disturbance by open mining and thereby <br />conserve natural resources, aid in the protection of wildlife and <br />aquatic resources, and establish recreational, home, and indus- <br />trial sites, to protect and perpetuate the tax:llile value of prop- <br />erty, ;urd to protect and promote the healt}r, safety, and general <br />welfare oC the people of this state. <br />2. 'Illese nlles shall govern ol~eratinns for the extraction of. coal, <br />s:md, gravel, quarry aggregate, mrd limestone for construction <br />}rurf~oses wldcr mining permits issued pursuant to the Colorado <br />0}~erl t`lining l,;rnd Reclamation Act of 1973, CILS 1973, 34-32-101, <br />et scy. (hereinafter referred to as the "Act"). <br />3. Tlwsc rules shall govern the reclamation of all open mining <br />operations on all lands within the State of Colorado. <br />• 4. All operators engaging in open mining shall comply with all <br />applicable state and local laws, codes, rules and regulations. <br />B. Definitions. <br />1. Acid urd toxic producin deposits -natural or reworked earth <br />material~iavin~en,ical"- and p~sical characteristics that, <br />Iulder mining or postmining conditions of drainage, exposure, or <br />other processes, may produce materials which contain detrimental <br />chemical constituents such as acids, bases, or metallic com- <br />pounds. <br />2.
