If you do not want <br />Sublease I, we will relinquish it to U.S. Steel as well. <br />As you are aware, we offered to convey all of the coal properties comprising <br />the Blue Ribbon Mine and the associated subleases and permits to the Allens, <br />subject to the necessary state and federal agency approvals, and on the condition <br />that the Allens assume all of the associated obligations and post the necessary <br />bonds. This offer was stated in Mr. Fanyo's May 6, 1986 letter to Mr. Woodrow <br />and expired on May 23, 1986. Had it been accepted ,the Allens would have <br />been able to begin operating the Blue Ribbon Mine immediately upon receiving <br />all of the necessary transfer approvals. We have received no response to <br />that offer from Mr. Woodrow or you, nor has Mr. Woodrow returned Mr. Fanyo's <br />telephone call to him on May 23, 1986. We take this lack of response to <br />mean that the Allens have no real intention of using the properties for coal <br />~N ~ <br />;~` <br />5 a <br />mining purposes. ~ 5~ 1(r ~ <br />Finally; please be advised that the remainin reclamation work required by C L~` ,• <br />the Colorado Mined Land Reclamation Division for the B ue Rib on Mine is J ~' <br />proceeding. As we have stated several times before,.it is our position. that ~~ ~• <br />re conveyance to the Allens of the property subject to the Agreement, reclaimed ~' <br />in accordance with the permit obligations, will comply with paragraph 11 '~• <br />of the Agreement.
