Mr. Allen - 2 - February 23, 1987 <br />The Aliens also raised concerns that the-mine may have to be reopened. If <br />this is the case, whoever decides to reopen the mine will need to file a <br />permit application with MLRD. Anew bond to cover reclamation under the new <br />permit will also be needed. The decision to reopen the mine has no bearing on <br />this bond release decision. <br />To summarize, the Aliens have raised concerns over whether the mine should <br />have been reclaimed. While we understand the Allen's concerns we have little <br />authority to tell the permittee when to close the mine and start reclamation. <br />Bond cannot be withheld from the permittee if reclamation was conducted in <br />accordance with the plan. <br />The Division must make a final proposed decision on the bond release request <br />by Plarch 16, 1987. If you have any other comments or questions you may call <br />Susan Mowry, Lead Project Specialist for the mine or myself. We will accept <br />any additional written comments up to Idarch 11, 1987.
