Exhibit M Other Permits, Licenses, and Approvals <br />Existing Permits, Licenses, and Approvals <br />1.) Emission Permit No. 82SU051(1) issued by the Colorado Department of Public <br />Health and Environment, Air Pollution Control Division, on July 21, 1986, for the <br />Concrete Batch Plant. As stated in the original Snowstorm Placer 112(c) <br />Technical Revision (TR-03) Application, if Everist Materials, LLC, is unable to <br />utilize the proposed plant, a similar plant will be located on the subject property. <br />2.) Air Pollution Emission Permit No. 05P00163 issued by the Colorado Department <br />of Public Health and Environment, Air Pollution Control Division, on September <br />1, 2005, for the Asphalt Plant. As stated in the original Snowstorm Placer 112(c) <br />Technical Revision (TR-03) Application, if Everist Materials, LLC, is unable to <br />utilize the proposed plant, a similar plant will be located on the subject property. <br />3.) Colorado Discharge Permit System-Stormwater No. COG-501400 issued by the <br />Colorado Department of Public Health and Environment, Water Quality Control <br />Division, on June 6, 2006. <br />4.) Pursuant to Case No. 95CW 170 of the Water Court, Water Division 1, State of <br />Colorado, the applicant is entitled to divert water from the Middle Fork of the <br />South Platte River. An existing pipeline and pump easement is located on <br />adjacent property to the Southwest for a water line and pump serving the subject <br />property. Case No. 95CW 1701imits delivery of water to 24 cfs (cubic <br />feet/second). <br />PendinE Permits <br />1.) Conditional Use Permit from Park County, Colorado, to allow a concrete batch <br />plant and an asphalt plant. The Planning Commission Public Hearing is scheduled <br />for April 10, 2007, and the Board of County Commissioners Public Hearing is <br />scheduled for May 17, 2007. Therefore, a final decision is anticipated in May of <br />2007. <br />2.) State Highway Access Pennit from the Colorado Department of Transportation. <br />An application was submitted on February 14, 2007, and a final decision is <br />expected by March 30, 2007. <br />3.) Septic Permit from the Park County, Colorado, Environmental Health Department <br />for a vaulted privy system on the subject property.
