Also, on June 9, 1983, the OSM issued NOV 83-2-6-2 <br />to Colorado Yampa Coal Company. This violation alleges excessive rills <br />and gullies, and is presently being contested by Colorado Yampa Coal <br />Company. <br />1. Colorado Yampa Coal Leasing Company (formerly Color- <br />ado Yampa Coal Company, formerly Energy Fuels Corporation) adopted a <br />Plan of Partial Liquidation on August 30, 1982, pursuant to which its <br />coal interests and other real property interests were transferred to <br />Getty Coal Company, which later transferred such interests to Getty <br />Minerals Marketing, Inc. Colorado Yampa Leasing Company transferred <br />its employees to the new Colorado Yampa Coal Company. <br />2. Colorado Yampa Leasing Company entered into a tem- <br />porary contract with Getty Minerals Marketing, Inc. to operate the <br />surface mine, and contracted with Colorado Yampa Coal Company for the <br />use of the employees for such operations, until the mining permit is <br />transferred. Colorado Yampa Coal Company will thereafter operate the <br />surface mine under contract directly with Getty Minerals Marketing, <br />Inc. <br />3. Twentymile Coal Company has contracted with Getty <br />Minerals Marketing, Inc. to operate the underground coal operations. <br />4. Mining equipment and facilities for the surface <br />mine operations is owned by Colorado Yampa Leasing Company and leased <br />to Getty Minerals Marketing, Inc. <br />The current status of the proceedings and of the <br />violation notice; <br />See response to this Section 2.03.6(1) in C-056-82. <br />Also, note the following: <br />
