Everist Inc. ~ Director
Mountain Division
9065 Quince Street
Henderson, CO 80640
RE: Technical Revision 003 to Permit No. NM-96-049, Maryland Creek Ranch
Dear Ms. Unger,
This letter is being written in response to your January 2l, 1999, letter, regarding the placement of inert fill
in the ponds at the Maryland Creek Ranch Pit, Permit No. #M-96-049. According to the permit, L.G.
Everist is in fact permitted to place inert fill in the ponds. However, notice to DMG in accordance with the
Construction Materials Rules and Regulations 3.1.5 is still required before placement of material.
Specifically, a written affidavit that the fill to be placed is clean and inert, as defined in Rule 1.1(20), must
be submitted prior to any filling, especially since the Division understands that the location from which the
fill is [o be obtained has changed since the initial application.
If you have any further questions, please contact me at (303) 366-3567.
Sincerely,_
Christina L. Kamnikar
Environmental Protection Specialist
CC: Carl B. Mount, DMG
R.A. Everist, L.G. Everist, Inc.
