OSMRE/WTC has <br />determined that the revisions in the enclosed list do not constitute a <br />modification to the approved mining plan under 30 CFR 746.18. Based on our <br />review, OSMRE/WTC concurs with the Colorado Mined Land Reclamation Division's <br />(MLRD) decision to approve these submittals, and the Federal permit CO-0013 <br />dated April lye3, is revised accordingly. <br />However, technical revision number 24 - increase in disturbed area within the <br />permit boundary and slight change to postmining topography, requires a mining <br />plan modification under 30 CFR 746.18(d)(1) pursuant to 746.13(b), <br />(d), (e), (f). The April 1y83 mining plan approval by the Assistant <br />Secretary for Land and Minerals was based on a concurrence by the Minerals <br />Management Service that limited the approval to the end of 1985• Detailed <br />information was only availsble for the then proposed 5 year period requiring <br />s limited mining plan approval under 30 CFR 746.17(x). The Colorado and <br />Federal permit approvals were similarly limited. The Colorado MLRD approval <br />specifically stated that their permit did not carry the right of renewal as <br />specified in 30 CFR 774.15 and Colorado MLRD Rule 2.08. <br />In order to review a mining plan to recommend approval by the Secretary's <br />office, OSMRE concentrates on the operation and reclamation plan. It is <br />important for this review that all maps include township, range and section <br />identification. The applicant should resubmit these maps. <br />Revised map M12 indicates that a topsoil stockpile and access road were <br />constructed in Section 5, T.SN., R. 91 W. This area is partially within a <br />prairie falcon buffer zone for which the U.S. Fish and Wildlife Service <br />prohibited activity between March 1 and July 31. The applicant should be <br />aware that no activity is allowed within the buffer zone during that period. <br />
