"E:CHIBIT E" BEFORE THE MIr1ED LAND RECLAMATION BOARD DEPARTMENT OF NATURAL RESOURCES STATE OF COLORA00 IN THE MATTER OF: ) FINDINGS OF FACT, ANDESITE ROCK ) CONCLUSIONS OF LAW Ar10 DECISION COMPArIY -FILE N0. 77-141 ) This matter was heard by the Colorado Mined Land Reclamation Board ("the Board") on April 25, 1984, and May 23, 1984 in Roam 110 of the Centennial Building, 1313 Sherman Street, Denver, Colorado. The Board conducted the hearing to consider Andesite Rock Company's request to amend permit numher 77-141 and also, to consider issues identified at the April 9, 1984 prehearing conference. ' The Board hereby issues the following findings of fact and conclusion of law. FINDINGS OF FACT 1. Andesite Rock Company's ("Andesite") permit application was received by the Mined Land Reclamation Division ("the Division") on ,luly 1, 1977. 2. Andesite leased the lands in the permit area from the owner of those lands, Hallyn F. Hall. These lands are located in the E 1/2 of the E 1/2 of Section 26 and the W 1/2 of the W 1/2 of Section 25, Township 3 north, Range 71 West of the 6th P.NI., in Boulder County. " 3. On November 1R, 1981, Andesite sent a notice of its application to ' t1 r. Hall addressed as follows: ~~~ ~+ Mr. Halwyn Ha11 ~' South Star Route Lyons, Colorado 80140 Mr. Hall's name was incorrectly~spelied and the zip code should have r,- read 80540. 4. On September 8, 1981, the original application was found to be complete by the Division. ;r 5. On November 19, 1981, the Board approved the original application with financial warranty set at $37,953.00 6. On December 29, 1981, permit No. 77-141 was issued for the original application. 4 7. On August 31, 1983, the Division received an application to amend the . permit increasing the permit area by..27 acres. ti 8.
