• significant forest cover and that this surface coal mining operation complies with the <br />Multiple-Use Sustained Yield Act of 1960 (16 U.S.C. §§ 528-531), the Federal Coa] <br />Leasing Amendments Act of 1976 (Pub. L. 94-377, 30 U.S.C. 201 et seg.), the National <br />Forest Management Act of 1976 (90 Stat. 2949), and the provisions of SMCRA. Based <br />on OSM's analysis and on the concurrence of the USDA Forest Service in its letter dated, <br />May 13, 2003, the Mine will not be incompatible with significant recreational, timber, <br />economic, or other values of the Gunnison National Forest. <br />I have determined that approval of this new mining plan will not have a significant impact <br />on the quality of the human environment. The environmental analysis prepared by USDA <br />Forest Service, BLM and OSM for the Final Environmental Impact Statement -Iron <br />Point Exploration License, -Iron Point Coal Lease Tract, Elk Creek Coal Lease Tract, <br />Delta and Gunnison Counties, Colorado and other environmental documents noted in the <br />Finding of No Significant Impact (FONSI), describe the impacts that may result from <br />approval of this new mining plan and its alternatives. The FONSI and supporting <br />environmental analyses are included in this decision document. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special conditions to the mining plan approval. <br />Publication of a notice in the Delta County Independent newspaper notified the public of <br />the availability of the administratively complete PAP for review. The last publication <br />• date was September 11, 2002. No public comments on the PAP were received after the <br />public notice was published. <br />The CO-DMG determined that a bond for $3,436,042 is adequate for the Colorado Permit <br />No. C-1981-022 associated with this new mining plan. The bond is payable to the State <br />and the United States. <br />A chronology of events related to the processing of the PAP and this mining plan decision <br />is included with the decision document. The information in the PAP, and pther <br />information identified in the decision document, has been reviewed by CO-DMG staff in <br />coordination with the OSM Federal Lands State Coordinator. <br />OSM's administrative record of this new mining plan consists of the following: <br />the PAP submitted by Oxbow Mining, LLC and updated through February <br />24,2003, <br />CO-DMG's Proposed Decision and Findings of Compliance for Permit <br />Revision No. 5, Sanborn Creek Mine, C-81-022, provided to OSM under <br />the cooperative agreement, <br />• <br />
