• The State's current permit area covers 13,180 acres.
Approximately 121 surface acres are disturbed within the State's permit area.
A total of 1,468 acres of Federal coal exist within the State's current permit area.
A total of 12.9 million tons of Federal coal exist within the current permit area.
A total of 7,629 acres of Federal surface land exist within the State's current permit area.
The post mining land use within the currently approved mining plan area is rangeland and
wildlife habitat.
III. The Proposed Action
This mining plan action consists of a mining plan modification for Federal lease COC-
61357. Specifically, the mining plan action proposed by Oxbow Mining, LLC consists of
opening the Elk Creek mine to:
extend mining and coal recovery from the "D" coal seam, of the Elk Creek Coal
Lease Tract, Federal coal lease COC-61357, within the area covered by Colorado
State permit C-81-022.
• The life of the mining operations is expected to continue for 14 years under Colorado
Permit No. C-81-022 and this proposed mining plan modification.
The average annual production rate for the Elk Creek mine would be 2.2 million tons per
year, but could reach a maximum production rate of 6.6 million tons per year.
The approved State permit area would not increase in size from its present 13,180 acres.
Surface disturbance within the approved State permit area would not increase from its
present 121 acres.
This new mining plan will result in 4,603 acres of Federal coal being included within the
approved mining plan area shown on the map included with this decision document.
Approval of this new mining plan will authorize mining of an additional 56.9 million
tons of recoverable Federal coal.
Approximately 7,629 acres of Federal surface lands will be included in the mining plan
area as a result of this action.
• The post mining land use within the permit and mining plan area will not change.
