• • o~~a~~
Resporue Pgh #4; Fences Inside the Pit Boundary -These fences will be n:moved as
mining progresses. The fences will not be reinstalled in their current locations. Maps have been
revised to show fence removal.
Exhibit C; 4f'ater Information
Response; Stormwater Permit - A s[ormwater discharge permit will not be requested
for the mine site itself but a permit may be necessary to address the access road form the county
road to the mine site. Runoff from this short stretch of road will be controlled by the use of "no
control". The mine site will not exceed 70 acres draining to a common point within the affected
area. The chosen control mechanism is reasonable and prudent considering that the flow channel
base is gravel and that the road way is less than 1/10 mile in total length.
Exhibit H; ~ldiije Information
Response; Wildlife Statement -The request for a new wildlife statement w;ts made to
the CDOW. They have sent a letter stating that the original letter presented in the application is
still valid for the new mine site (see attached).
Exhibit K; Climate Information
Response; Precipitation Data -There are no near weather stations to supple actual site
data. Annual precipitation is estimated from the NOAA "Average Annual Precipitation" data for
Colorado 1961- 1990 at l7 inches. Monthly distribution of this precipitation is estimated by
proportioning it in accordance with the SCS soil survey "Delta -Montrose Area".
Jan 1.12, Feb 1.12, Mar 1.12, Apr 1.87, May 1.31, Jun 0.93,
Jul 1.31, Aug 2.43, Sept 1.87, Oct 1.68, Nov 1.12, Dec 1.12.
Exhibit N; Source ojlega! Right to Enter
Response; Right to Enter for Mining and Reclamation -Please re-read Lease Purchase
Agreement Pgh #2, Pg ]and from Pgh #3, Pg 4 through Pgh #2, Pg 5. Lessor has both right and
obligation to keep the entire mine site in full compliance with MLRB regs. No additional
statements appear to be necessary.
Exhibit P; Municipalities Within Two Mile Radius
Response; Lujane and Cedar Creek -Exist only in the history books and the USGS
Quad Map.
Exhibit S; Permanent Man Made Structures
Response; Fence line Ownership -Please see Response to Exhibit C Pgh #4.
RecE~ived
NOV281997
4
Divisp~ a~ e, ~ ~~It>g~r
