Box 68 <br />Craig, Co 81626 <br />RE: TR-34 Alternate Land Use, Permit C-81-071 <br />Dear Mr. Johnson: <br />As we discussed on the phone on Thursday, October 1, 1992, the Division has <br />determined that your revision to change all remaining rangeland affected areas <br />to pastureland should be processed as a permit revision rather than a <br />technical revision. The reasoning supporting this decision is twofold. <br />First, by definition, a technical revision is a minor change in the terms or <br />requirements of a permit. 1•le feel that the re-designation of all rangeland to <br />pastureland and the subsequent elimination of the shrub component of the <br />vegetation is not a minor change given that the original permit approval did <br />not consider potential impacts of this land use. Secondly, as per Rule <br />4.16.3(5), the Division is required to invcive ether State and federal fish <br />and wildlife agencies ccncel-ning measures to prevent or mitigat? adverse <br />effects on wildlif?. This rule also allo~.as a 60-day revie~.v period r~hich <br />coincides ~,vith the adequacy review period of a permit revision. <br />Please run your public notice to meet the requirements of Rule 2.07.3(2).
