Box 184 <br />Toponas, Colorado 80479 <br />RE: Routt County - "Hewes Pit" - File No. M-78-314 <br />Dear Mr. Hewes: <br />Our Division has received the succession of operators form for permit no: <br />M-78-314 from Routt County with a cover letter requesting that we inform you <br />concerning the financial warranty requirements. Please be advised that the <br />succession of operators form itself has been properly executed and is thus <br />acceptable. <br />All operators are required to submit a Performance Warranty. I have enclosed <br />a nearly completed copy of this form. Please complete and sign this form, <br />having your signature properly notarized. When complete, submit this form <br />with your Financial Warranty. <br />A Financial Warranty must also be submitted by all mining operators. <br />Typically, fora 9.9 - acre, limited impart operation such as yours, the <br />amount of this warranty is set by our Board at E5,000.00. (Routt County had <br />submitted no Financial Warranty since counties are exempted from this <br />requirement.) If you feel that you can clearly demonstrate that the permit <br />area can be reclaimed according to the permit for less than E5,000:00 (not by <br />you, but using a state-hired contractor), please submit your suggested amount <br />of financial warranty and your justification of this amount. Our staff will <br />then review your submittal and we can eventually agree on a correct amount; <br />allowing you to then suhmit the Financial Warranty. Otherwise, simply send in <br />a financial warranty in the amount of 55,000.00 and we will not need to delay <br />the permit transfer by a review of your suggested reclamation costs. <br />I have enclosed partially completed forms for the two financial warranty <br />options most commonly used by individuals. The first form is to be used with <br />a certificate of deposit.
