Hart, P.E: Landmark Engineering, Ltd: (970}667-6286
Section 15, Twp 5 North, Rng 67 West, 6th P.M., Latimer County
CONDRIONS FOR APPROVAL
® The purpose of the amendment is to add a 7.74-acre parcel to the permit area to enable the operator to
mine an additional cell #10 of approximately 8 acres.
® The proposed operation will consume ground water by: ®evaporation, ®dust control, ®reclamation,
® water removed in the mined produG, ®processing, ®other: dewatering.
Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel pit or
other type of well permit, as applicable. However, prior to obtaining a permit, an approved water supply
plan or decreed plan for augmentation is required. The existing substkute water supply plan for the
Latimer Pit expired on February 28, 2008. A renewal request for a substitute water supply plan was
submitted on January 16, 2006 and this plan is pending evaluation.
® A well permit was obtained for the current use and exposed pond surface area of the gravel pit, permit
no. 62009-F in accordance with Section 37-90-137(2) and (11), C.R.S. The applicant may be required to
obtain a new well permit if the proposed mining of cell #10 will expand the uses allowed under permit no.
62009-F.
^ The proposed operation may have potential impact on existing water rights near the project location.
Applicant needs to demonstrate that the proposed project will not alter or impact the historic operation of
existing water rights.
^ The applicant has indicated plans to use other water for purposes at the permit site. The source
of water for this use is to be obtained from Applicant needs to document that this water was
diverted in priority under a water right decreed for such industrial use. Applicant should contact the
water commissioner for further information.
® An augmentation plan for the Latimer Pit site was filed with the Division 1 Wafer Court in Case No.
2000CW143. Loveland Ready-Mix Concrete, Inc. has also obtained storage water rights in Case No.
98CW431 for storage in two of fhe pits within the site, identified as pit 16 and 17. _
COMMENTS: If slormwater runoff is intercepted by this operation and is not diverted or captured in priority, it
must be released to the stream system within 72 hours. This may require a discharge permit from CDPHE-
WOCD. Otherwise, the operator will need to make replacements for evaporation.
The applicant may contact the State Engineer's Office with any questions.
