G~ ~:,~~,; <br />Basin Resources proposes, as a minor permit revision, the <br />addition of the following underlined language to the current <br />version (as shown by the non-underlined text) of stipulation <br />No: 28: <br />The permittee shall perform a survey of the five <br />potentially affected adobe constructed hcuses on a <br />quarterly basis, in conformance with the requirements <br />of Rule 2.05.6(6)(c)(i)(D), at such time as underground <br />mining recommences within the First North mains. <br />The purpose of the proposed additional language is to <br />reflect the original understanding between Basin and the <br />Department of Natural Resources in light of the revisions <br />subsequently made to Basin's permit and mine plan: that <br />Basin will incur obligations under Stipulation No. 28 at <br />such time when it recommences mining operations within the <br />vicinity of the five adobe houses. When it entered into <br />Stipulation No. 28 in 1989, Basin contemplated that the <br />First North mains might extend directly beneath or within an <br />area that potentially could affect certain adobe constructed <br />houses. However, as contemplated under the minor revision <br />regulation, S 1.04(73); the timing and sequencing of mining <br />within Basin's mine plan subsequently changed, indefinitely <br />delaying the onset of the situation addressed in Stipulation <br />No. 28. In August of 1988, Basin ceased all mining <br />operations within the First North Area, and capped <br />operations at a point more than 340 feet from the nearest of <br />the potentially affected adobe houses. Basin's current <br />mining operations and foreseeable mining plans do not <br />
