Pit (Permit No. M-87-064) Use of Technical Revision <br />rather than Amendment to simultaneously remove and add acreage to permit <br />area when resulting affected acreage is not increased <br />Dear Mr. Dillon: <br />Following our conversation on the topic referenced above, I explored the issue <br />with Mr. Bruce Humphries, Minerals Program Supervisor. <br />It is the Division's position that, regardless of the eventual total acreage <br />in the permit area, when acreage is added to a permit area, then potential new <br />impacts may result to adjacent property owners, structures, etc. The use of <br />• an amendment with the associated public notice requirements is a means of <br />making adjacent property owners aware of these potential impacts. As we know, <br />there are no notice requirements for a technical revision. <br />A similar situation is being brought before the Mined Land Reclamation Board <br />in June, and the decision regarding that situation may affect your property <br />and/or the Division's position. You may wish to wait to hear the results of <br />that determination. <br />On another matter, the Division is still trying to process your request for <br />reclamation responsibility release for that tract of land reclaimed by <br />Red Cliffs Development. Would you please provide the division with a map <br />showing the area to be released and indicate the acreage of the release area. <br />If you have questions or need assistance, please contact the Division. <br />Sincerely, <br /> <br />James C.
