Box 191 Dlvlsion Dveaor <br />Victor, CO 80860 <br />RE: Cresson Project, Technical Revision Approval, Permit No. NI-80-294, Revision No. TR-27 <br />Dear Mr. Lewis: <br />On October 13, 1998 the Division of Minerals and Geology approved the Technical Revision application submitted to <br />the Division on August 06, 1998, addressing the following: <br />Haul road realignment, change operational slope from 2:5-1 [0 1:6-I <br />The terms of the Technical Revision No. 27 approved by the Division are hereby incorporated into Permit No. <br />M-80-244. <br />The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M-80-244 <br />remain in full force and effect. <br />Stipulation No. Description <br />17 CC&VG will submit a design for a surface water diversion that is adequate to handle the 25 <br />year 24-hour event to divert runoff away from the upstream face of the haul road fill prior to <br />building the road. Operator will commit to inspect and maintain the diversion to make sure <br />that ponding will not cause the development of phreatic surface in the overburden material. <br />18 Operator will provide a slope stability evaluation for the proposed steepened slope's cross <br />section located between grid stations 35000E and 36000E on figure ttl of Attachment 4 of [he <br />Technical revision application prior to commencing with steepening of the slope. <br />19 CC&VG will submit an emergency response plan is case failure of the ore side slope takes <br />place outside of the lined area due to ore rotating or sliding because of a lower slope angle. <br />]f you have any questions, please contact me <br />Sincerely. _ <br />~--r <br />~ ~_~ <br />Berhan Keffelew <br />Environmental Protection Specialist <br />M :1055\ P M1I M \T E AI P\ M R V 02313.
