Waldron Reclamation Division <br />Colorado Mined Land Reclamation Division <br />215 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203-2273 <br />RE: Minor Revision 91-19, Permit C-81-044, Development Mining <br />Under Structures & Renewable Resource Land <br />Dear Mr. Waldron: <br />Cyprus Empire Corporation (CEC) is requesting this minor revision <br />in order to obtain approval to proceed with development mining <br />within 6 Mine under structures and resource land (Railroad Spur, <br />State Highway 13, Williams Fork River and associated Alluvial <br />Valley Floor). This mining was projected within the current 5 year <br />mine plan as shown on Map 24 of the current permit C-81-044. Page <br />2.05.6(6)-14 specifically says development mains will be driven <br />under the Williams Fork River. However, there is evidently some <br />confusion regarding statements in Exhibit 39 of permit C-81-044 <br />which state there would be no new mining under these structures and <br />renewable resource land during the 5 year permit term. It should <br />be noted that these statements were made in reference to concerns <br />over subsidence caused by full extraction mining. It was not CEC's <br />intent to exclude all mining under these structures and renewable <br />resource land but only that mining which would cause subsidence and <br />potential material damage. As stated in the permit and the <br />findings document, CEC does not plan to subside any of these <br />structures or renewable resource land of concern within this 5 year <br />permit term. However, CEC does plan to extend mains and submains <br />under these structures and renewable resource land, within this 5 <br />year permit term. CEC plans on using standard methods already <br />approved for main and submain development. CMLRD has previously <br />approved this type of mining under these structures and renewable <br />resource land in both the #5 and #9 mines.
