Employees of Empire were questioned concerning the conswction of the refuse pile well and from <br />those discussions it was ascertained that the well was constructed in stages as the depth of the refuse <br />increased. The well was constructed by placing refuse material around the perforated CIV1P, placing the <br />perforated PVC inside of the CMP and placing a gravel pack in the annular space. The well was <br />advanced in stages as the depth of the refuse material increased. In reference to the eft-iciency of the well <br />it should be understood that it is merely installed for monitoring purposed of a water table in placed <br />refuse, which is not an aquifer. The well is adequately conswcted for its intended purpose. <br />I5. The PHC has been revised and responds to the Division's concerns. <br />l6. Empire believes it has adequately addressed the concern addressing adequate an adequate volume of <br />non-tonic material to be used as cover over the refuse pile. It should be noted that this pile is not <br />constructed to the extent that non-tonic nutterial has to be placed over any of the outslopes. Empire <br />understands that if a cover depth reduction is requested it will have to demonstrate to the Division that a <br />lesser depth is justified through evaluation of the refuse material chemical and physical characterization, <br />and any resulting vegetation studies which would show no impacts to successful revegetation of the pile. <br />I Z [n [he interest of perspicuity, Page 2AS.4-24R has been revised to state that the "Red Rock Crusher" is <br />the only previously mined area. <br />l8. The cropland <br />success standard would be for the entire field anv would be recorded as the bushels harvested from [he <br />area. The field will be cut and the grain loaded into trucks and hauled from the site. The Wcks will be <br />weighed and this weight will be used in de[ernrining the bushel per acre yield after the appropriate Ibs/ <br />bushel is de[ernrined. Page 2.05.4-24Ra has been revised to provide a description of woody plant sampling <br />procedures. <br />
