<br />Proposed Decision <br />The Colorado Division of Minerals and Geology has issued a proposed <br />decision to deny a Phase II/III bond release request for Block A, <br />Mine 2, Permit fC-81-071, operated by Colorado Yampa Coal Company. <br />This application requested final bond release for approximately 313 <br />acres of pastureland reclamation. The request was denied, in part, <br />due to the lack of statistically adequate data demonstrating that <br />the lands included in the release area had been revegetated to the <br />standards required by the Rules regulating coal mining and the <br />standards in the approved permit. Sediment demonstrations, rill and <br />gully repair, and permanent ditch approval were additional areas <br />which had deficiencies contributing to the denial. A written <br />findings in available for public inspection at the Colorado <br />Division of Minerals and Geology, 1313 Sherman St., Rm. 215, <br />Denver, Colorado 80203. Any person who might be adversely affected <br />or the head of any governmental agency which has jurisdiction with <br />respect to environmental, social, or economic impact involved in <br />the operation may request an adjudicatory hearing in front of the <br />Mined Land Reclamation Board. The request for a hearing must be <br />written and state with specificity the reasons for the hearing. It <br />must be received by the Division no later than 30 days from the <br />first publication of this notice. <br />
