West Elk Mine is responding to the Division's first adequacy letter <br />dated October 25, 2004 for the Thermal Event Area (SL-O1). At this time comments (1-3) regarding the <br />Thermal Event Area bond release in the October 250i letter have been addressed. The original CDMG <br />requests are numbered and italicized and MCC's responses to correct these requests aze listed below. <br />MCC's responses aze in bold type. <br />(1) Please provide certiftcation by a registered professional engineer for tl:e <br />cross-sections provided in the application package, according to rule 2.10.~~(2) <br />MCC's Response: Attached are the certifications by a registered professional <br />engineer for the cross-sections provided in the application package, according to rule <br />2.10.3(2) <br />(2) Please provide a certified engineering report to show that the bacl~lled and <br />regarded slopes have a minimum static safety factor of at least 1.3, as required by <br />Rule 4.14.2(1)(6) <br />MCC's Response: Attached is a report from a certified engineer to show that the <br />backfilled and regarded slopes have a minimum static safety factor of at least 1.3, as <br />required by Rule 4.14.2(1)(6) <br />(3) The Thermal Event Area has been managed as a small area exemption (SAE) <br />since the original disturbance. The area has been regraded and revegetateci, but is still <br />considered a small area exemption. Please provide demonstrations for the individual sites <br />within the thermal event area to show that the drainage from the disturbed area does not <br />contribute suspended solids above the natural conditions and the quality of untreated drainage <br />meeting State and Federal water guality standards, as required by Rules 4.05.2(2) and <br />4.05.2(3)(a) <br />
