Peter Mattheis - 3 - July 5, 1990 <br />The letter from MSHA concerning permitability of underground waste disposal <br />speaks of storage of incombustible material only, but does not address <br />permanent disposal of coal processing waste. As stated before, the plan <br />reviewed by the Division must be approvable by MSHA. Without an acceptable <br />disposal plan for coal waste this revision cannot be approved. <br />Please clarify as part of the forthcoming adequacy response the current status <br />of the Department of Health Air Quality Permit(s) and any local Special-Use <br />permits . <br />The application must also clarify how many feet of the haul road is to be left <br />in following reclamation of the site, and should state clearly the reclaimed <br />or active status or other roads on the property. <br />Miscellaneous <br />NCEC is encouraged to submit a Weed Management Plan as suggested by the <br />Division's Weed Guidelines distributed in April, 1990. <br />There is no indication in the application of where non-coal wastes will be <br />stored prior to off-site disposal. Rule 4.11.4(1) allows such storage only in <br />designated locations of the permit area. <br />Please note that per Rule 2.U1.4(2)(a), and since an Informal Conference was <br />held on June 21, 1990, the revised decision date for this Revision is <br />August 19, 1990.
