Banta, <br />Division Director <br />RE: Adequacy Review, Coal Ridge No. 1 Mine (C-84-065), Permit Revision 1 <br />Dear Mr. Mattheis: <br />The Division has reviewed the adequacy responses submitted by you to date. <br />Many of the concerns cited in this office's preliminary adequacy letter have <br />been resolved by those submittals, however additional information and <br />clarification is required under certain Rules. <br />Rule 2.03.4 <br />NGEC's new address and phone number should be listed here. <br />Under the legal description of the permit area on page 2-1, item (H) should <br />read "T6S, R91W, Section 12: All lands in N/2 NE/4 and NE/4 NW/4". <br />Rule 2.03.6 <br />A sample of the private coal lease has been provided, as have copies of most <br />of the signature pages. No evidence of an executed lease with Brinkley Brown <br />has been provided to date. Prior to approval of the revision, the proposed <br />permit area must be covered by valid lease agreements, which demonstrate <br />NCEC's right to enter and tonduct operations. <br />Rule 2.04.10 <br />After discussions with Tom Colbert of Intermountain Soils and with other <br />Division personnel, it was decided that use of the existing vegetation <br />reference area (not within the proposed permit area) was acceptable if written <br />assurance was received from the Bureau of Land Management concerning continued <br />access and proper management. No such letter has been received. <br />Rule <br />05,3(3) <br />The map of the proposed loadout facility west of Rifle (Fig. 4.3-8) is unclear <br />o the location of the permit boundary. The text on page 4-24 speaks of a <br />acre lease area, while the area depicted on figure 4.3-8 is at least 7 <br />acres in size. Also, NC EC should provide a copy of the executed lease or <br />agreement with the Denver and Rio Grande Western Railroad which provides right <br />of entry. NCEC will also need to provide documentation of any necessary <br />special use permits, DOH Air Emissions permits, and NPDES permits for this <br />site. <br />as t <br />1.5 <br />
