4 <br />--~ • -s <br />NOTICE OF PROPOS-cD DECISION <br />The Colorado Mined Land Reclamation Division has approved with conditions an <br />application for a revision (PR - 001> to the existing permit to conduct coal <br />mining and reclamation operations submitted by the Peabody Coal Company, <br />Western Division for the Seneca II-W Mine. <br />The Seneca II-W operation is iocated in in Routt County, approximately 7 miles <br />south of Hayden, Colorado. The mine is a surface coat mine with an <br />anticipated maximum production capacity of 1,050,900 tons per year. The coal <br />to be mined is federally & privately owned, and the surface to be affected is <br />state & privately owned. The revised permit area encompasses approximately <br />2,676 acres. The legal description is as follows: <br />Mining Area <br />TSN, R88W Section 9, portions of E 1/2 E1/2, W 1/2 NE 1/4 <br />Section 10, 5 1/2 S 1/2 NW 1/4, SW 1/4, portions of S 1/2 NE 1/4, SE 1/4 <br />Section il, portions of S 1/2 SW 1/4 <br />Section 14, portions of SW 1/4, NW 1/4, S 1/2 S i/2 SE 114 <br />Section 15, portions of NW 1/4. All of NE 1/4, SE 1/4 and SW 1/4 <br />Section 16, portions of W 1/2 NW 1/4, SW 1/4, SE 1/4 <br />Section 21, portions of E 1/2 Ne 1/4 <br />Section 22, NW 1/4, NE 1/4, N 1/2 SE 1/4, portions of S 1/2 SE 1/4, <br />N 1/2 SW 1/4 <br />Section 23, NW t/4, SW 1/4, portions of NE 1/4, SE 1/4 <br />Containing 2,462.1 acres. <br />Tie-Across Haul Road <br />T6N, R88W Section 14, portions of <br />Section 23, portions of N i/2 <br />Section 24, portions of N 1/2 <br />T6N, R87W, Section 17, portions of <br />Section 18, portions of SE 114 <br />Section 19, portions of N 1/2 <br />SE 1/4 and portions of SW 1/4 <br />SW 1/4, SE 1/4, NE 1/4 <br />Containing 214.5 acres <br />This proposed approval decision is based on a finding that the proposed <br />operation will comply with ail requirements of the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 34-33-101, et sea., and the regulations <br />promulgated thereunder. <br />Copies of the proposed decision including stipulations, are on file for public <br />inspection at the Colorado Mined Land Reclamation Division, Room 215, <br />Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the <br />County Clerk's Office in Routt County, 522 Lincoln, P.O. Box 773598, Steamboat <br />Springs, Colorado. Persons with an interest that may be adversely affected by <br />the proposed decision may request a formal hearing before the Mined Land <br />Reclamation Board on the proposed decision. Such request must be made within <br />thirty (30) days of the initial publication of this notice, must be in <br />writing, and must state with reasonable specificity the reasons for the <br />request and the objections to the proposed decision. <br />409UG <br />
