Cattany <br />Division Director <br />,/ Natural Resource Trustee <br />RE: Canna Bayshore, LLC, St. Vrain Lakes, Permit No. M-1982-015; Technical Revision 02 <br />Clarification Request ~ <br />Deaz Ms. Villa, <br />The Division received the Technical Revision request from the Applegate Group, Inc. on behalf of <br />Carma Bayshore, LLC on November 21, 2006. Upon review of the information provided in the <br />package, there aze two items that require written clarification. <br />During a phone conversation with Donald Frick of Applegate Group on December 5, 2006, he <br />agreed to provide the required clarification for the following issues: <br />1. Please confirm the commitment to two separate monitoring plans -twelve months of <br />ground water monitoring data required to be submitted to the Division on a quarterly basis <br />and three months of perimeter drain effectiveness monitoring. <br />2. The Technical Revision submission was unclear as to the timing of the three months of <br />perimeter drain effectiveness monitoring. It is required that this effectiveness evaluation <br />occurs during the spring runoff months -the months most likely to provide the clearest <br />indication of the perimeter drain's proper functioning. Please confirm that this three month <br />perimeter drain evaluation shall occur between April 1 and July 1. <br />We look forward to your response to this request for clarification on this Technical Revision. <br />Please be advised that this Technical Revision submission may be deemed inadequate, and the <br />application may be denied on December 21, 2006, unless the clarification information <br />requirements listed above aze addressed to the satisfaction of the Division. If you feel more time is <br />needed to complete your reply, the Division can grant an extension to the decision date. This will <br />be done upon receipt of a written waiver of your right to a decision by December 21, 2006 and <br />request for additional time. This must be received no later than the deadline date.
