<br /> <br />The four inch gray water inlet pipe will extend partially down <br />• the pond embankment and will discharge .onto a plastic sheet to <br />prevent erosion of the embankment. There will be no other inflow <br />into the pond from surface sources. The only discharge from the <br />impoundment will be to the land application area, <br />Land Application Area <br />The area selected for the land application of gray water <br />discharge is a permanent pasture which has been occassionally cut <br />for hay. It is composed of pasture species and alfalfa. With <br />the advent of the mine operation, the area will be fenced and <br />excluded from grazing or access by the general public. It will <br />not be cut for hay. <br />Gray water will be spread evenly over the surface by discharging <br />the water into a contour furro W or a perforated pipe located on <br />the uphill side of the land application area. Gray water will <br />not be allowed to become channelized and flow from the area,. If <br />the land application area becomes saturated, the discharge of <br />gray water will be discontinued until it has percolated into the <br />subsoil material. <br />After the construction phase is ended and the permanent bathhouse <br />has replaced the temporary shower facility, the site will be <br />• reclaimed. Reclamation will consist of removing the shower <br />trailer and the 4 inch pipe. The impoundment will be drained and <br />regraded. Topsoil will be respread and seeded according to <br />procedures approved in the MRP. All incidentially disturbed <br />areas such as the drain pipe location, will be reseeded. <br />New Castle Energy Corporation requests approval from the Division <br />to establish and operate a temporary shower facility described <br />above. Of particular concern is the discharge of gray water. <br />The plan has been reviewed verbally with Don Holmer of the <br />Colorado Department of Health who deemed it acceptable. He <br />specified that the CMLRD must approve the activities; but, the <br />only stipulation required for discharge of the gray water is that <br />it meet the water quality standards set forth in the NPDES <br />permit. He also commented that the gray water could be treated <br />as necessary to achieve the water quality standards and <br />discharged in a pasture land application. It is felt that the <br />proposed plan meets these concerns and follows the intent of the <br />laws governing this matter. <br /> <br />
