~l z~~o ~ <br />~D~ G. - CST <br />S ~N~:m Seneca Coal Company <br />Jnly 17, zoo6 <br />George Fnederich <br />1267 Bemazdo Ridge Place <br />Escondido, CA 92029-5632 <br />RE: Response to Letter Dated Jme 13, 2006 <br />Deaz George, <br />~" r~ ~~ <br />t <br />~~_ s <br />We received and considered the requests in the letter you sent It has been our understanding that the Colorado <br />Department of Minerals and Geology previously sent you an electronic copy of the Seneca II-W peanit document. <br />However, in response to your concern, the only significant change to that document is the reclamation schedule, which <br />we have provided a copy of the map showing the proposed updated timing of backfilling and grading. The stains of the <br />two sediment ponds, # 016 and 016A, has not changed; you will be notified regarding retention of these structures <br />when appropriate (as required by Colorado Law). <br />As faz as the Phase I Bond Release application, the azea in which Phase I bond release has been requested is in the <br />northern portion of the mine azea and includes a small portion of your property in the NE Y. of Section 26 along the <br />top of the adge. Phase I bond release only includes backfilling and grading (the heavy dirt work) and post mine channel <br />construction. Phase II bond release includes azea that has been topsoiled and revegetated for at least two years. Phase <br />III is final bond release and requires at least 10 years of revegetation. <br />The documents, as referenced in your letter, can be reviewed at the Colorado Department of Minerals and Geology <br />offices or at the Hayden Public Library.
