Lndrhead <br />6ecWive Director <br />ntichael B Long <br />Dwision D~renn. <br />The Division has reviewed the amended Subsidence section (Tab 20) <br />of the PR-02 revision application. The one remaining concern we <br />have is with respect to the PSCO powerline subsidence mitigation <br />plan. The Division has never accepted an agreement freeing the <br />operator of responsibility for damage as adequate to satisfy this <br />requirement. Rather, mine companies have been required to <br />demonstrate that their activities will not result in impacts off <br />the permit area. With respect to possible subsidence effects to a <br />powerline, it is the responsibility of the operator to demonstrate <br />that if the worst case impact, failure, were to occur, electrical <br />service would not be interrupted. In an analagous situation at the <br />Foidel Creek Mine, this requirement was satisfied by a statement <br />from the utility that its grid was sufficient to compensate for a <br />temporary interruption in the integrity of the powerline. <br />Powderhorn will need to obtain a similar statement from PSCO to <br />document that the power grid is capable of sustaining interruption <br />due to subsidence without impact to electric service off the permit <br />area. <br />Please contact me if you have any questions. <br />sincere ~ "~~~~` <br />Dan T. athe s <br />Environmenta Protection Specialist <br />cc: Larry Routten <br />Jim Pendleton <br />
