The operator has requested that additional time be granted to reduce the reclamation liability. <br />Such an extension would not adversely affect the public health or safety or cause significant <br />environmental harm to land, air or water resources. <br />20. Any action that results in bond forfeiture at this time, would result in the State of Colorado <br />assuming responsibility for a slightly underbonded and unmaintained site. <br />21. It is in the State's best interest to allow the operator additional time to reduce the reclamation <br />liability and to continue maintenance of the mine site. <br />CONCLUSIONS OF LAW <br />Rule 3.02.2(1) states: "The amount of the bond shall be sufficient to assure the completion of <br />the reclamation plan if the work had to be performed by the Board, through independent <br />contractors, in the event of forfeiture." <br />2. Pursuant to Rules 3.02.2(4) ana 2.07.4(3)(d}, the Board may grant temporary• relief from the <br />Division's decision to increase the bond amount. <br />BOARD ORDER <br />By June 21, 1994, the operator shall reduce the reclamation liability at the O.C. Mine No. 2 to <br />$36,000; or, <br />2.
