1 ' ~ • ` <br />I • ~ <br />-.-.\ ., <br />the debtor's property to the Metropolitan District will <br />remove the property from the tax rolls of Pueblo County <br />during the administration of the trade program, that such <br />removal will not be burdensome to the taxpayers of Pueblo <br />County or the taxpayers of the Metropolitan District <br />I <br />because the taxes on the property to be conveyed by the <br />Trustee to the Metropolitan District are not presently <br />being paid, have not been paid for the last several years, <br />and further, there is no prospect of future payment of the <br />taxes on this property by the Trustee or any other person, <br />firm or corporation. <br />(h) The Metropolitan District shall retain the right <br />to give lot owners who are delinquent on their purchase <br />money payments or on their water and sewer assessment <br />payments, 90 days notice in which to bring those payments <br />current or have their contract rights terminated or <br />rejected by the Trustee, subject to Bankruptcy Court <br />approval. After such terminations or rejections, the lots <br />forfeited shall also be conveyed to the Metropolitan <br />District and placed in the trade pool. In this regard, the <br />Metropolitan District shall be solely responsible for all <br />notices to be sent over the Trustee's name after the <br />Trustee's approval of such notice and shall be solely <br />responsible for processing the replies to such notices and <br />JOINT MOTION TO AUTHORIZE SALE DF REAL PROPERTY <br />OF THE ESTATE FREE AND CLEAR OF ALL LIENS, CLAIMS <br />AP7D ENCUMBRANCES AND SETTLEMENT AGREEMENT - Page 8 <br />
