Box 1352 <br />Palisade, Colorado 81526 <br />Mr. Gifford Allen <br />Allen Brothers Coal <br />2945 Hwy 92 <br />Hotchkiss, Colorado 81419 <br />RE: Blue Ribbon Bond Release Decision - Request for Continuance <br />File C-81-047 <br />Gentlemen: <br />The Division received a request for an adjudicatory hearing with the MLRD <br />Board on April 20, 1987. In accordance with Rule 3.03.2(6) the hearing must <br />be held within 30 days of the request unless a continuance is requested. The <br />Division is requesting that Blue Ribbon Coal Company and Allen Brothers Coal <br />agree to a continuance for about one month. <br />The Continuance would ensure that more favorable weather conditions will exist <br />at the time of the hearing, in case the Board desires an on site visit. In <br />addition, several new Board members will start their terms in May and it is <br />not known whether enough board members will be able to attend the hearing to <br />provide a quorum. - Both parties have verbally indicated they would consider a <br />continuance. For our files, would you sign the attached form and return it to <br />our office within 10 days. You will be contacted in mid May with details of <br />the time and place of the June hearing. <br />The Division recognizes that the Allen Brothers have a legal right to object <br />to our decision and a right to request a hearing near the mine. However, the <br />Division would prefer not to call a special Board hearing in Paonia, since it <br />would mean another 1 1/2 days of business for board members and staff, as well <br />as considerable expense to the State. In the interest of resolving the issues <br />and avoiding the hearing I would like to encourage Blue Ribbon and Allen <br />Brothers to meet again to see if the differences can be worked out without <br />outside intervention. To this end, I would like to invite both parties to <br />meet in early May. The Division is willing to offer private conference rooms <br />in Denver and we have obtained permission to use conference rooms at the <br />Department of Highways, in Glenwood Springs and Colorado Mountain College, <br />near Carbondale if you prefer to meet somewhere between the mine and Denver. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
