OF MINERALS <br />Denver, CO 80203-2273 rIGEOLOGY <br />RE: Seneca II-W Mine Permit C-82-057, Stipulation 24 <br />Dear Mr. Boulay: <br />Stipulation No. 24 was attached to the Seneca II-W Mine Permit C- <br />82-057 upon the approval of Minor Revision No. 42 on July 29, <br />1997. This stipulation stated that Seneca Coal Company submit to <br />the Division proof of resolution of Kentucky civil penalty <br />violation and bond forfeiture associated with permit number <br />8980140. Within the Peabody Group of coal mines, permitting <br />personnel at the individual mines do not perform any work related <br />to the Applicant Violator System (AVS). All AVS work is handled <br />by our corporate personnel in St. Louis. <br />They were informed to provide me with an update pertaining to the <br />permit in question. Attached is a facsimile report that was sent <br />to me in return. Based on the cover page message, this permit is <br />not for a Peabody Group mine. The remaining pages are the <br />supporting documentation for this statement. I would ask that the <br />Division review this material, since I am not familiar with the <br />AVS to begin with. If in fact this is true that the permit in <br />question is not related to Seneca, then we are providing this <br />data to the Division in response to Stipulation No. 24 to the <br />permit and that this stipulation has now been satisfied. <br />Should you or any other members of the Division have any <br />questions concerning the enclosed materials, please do not <br />hesitate to contact me. <br />Sincerely, <br />m(~W • ~~ <br />Michael G.
