Most of the Division's concerns were adequately addressed and will not be mentioned in this letter. Items that still need to be addressed are as follows: 1. 6.4.3(f) -You identified a small irrigation ditch on Exhibit C located in the north part of the permit area, that parallels the Rio Grande Lateral No. 1. ~ ~ You failed to identify the owner of the ditch. In addition, you need to inform the Division whether the ditch is still being used to irrigate cropland downstream of the permit area. Also, as we discussed at the informal conference, you must show the location of the water well on the Richardson property if it is within 200 feet of the affected area. 2. 6.4.3(g) - As we discussed, if the manmade structures (mobile homes, etc.), on the Richardson property are within 200 feet of the affected area they ~ must be shown on Exhibit C map. The new map that was submitted shows a shed but no mobile homes. ~~ Does this mean that the only structure on the Richardson property, that lies within 200 feet of the affected area, is a shed? As previously mentioned, you must reach agreement with the owners of the structures to pay for any damage or provide an appropriate engineering evaluation that demonstrates that your activities will not damage the structures.
