I reviewed the material you provided, which includes the wetland
delineations on both sites, as well as your cover letter stating that: "We
stated in our mining plan that we intend to stay out of the wetland areas
and provide slit fencing where appropriate so that adjacent operations will
not discharge material into these areas."
MY review also included a phone call to the wetland consultant. Based
on the information provided, it is clear that the wetland areas at Gray 1
Gravel Pit are not jurisdictfona! under the Clean Water Act since they are
all isolated from and not adjacent to a jurisdictional stream. The wetland
and spring complex at Gray 2 Gravel Pit is jurisdictional under the Clean
Water Act since it is Dearly tritwtary to a jurisdictional stream. The
jurisdictional wetland appears to be accurately mapped, with supporting data
sheet documentation.
Since there will not be a fill into the jurisdictional wetland, and it
wiU be protected from sediment loading by a sift fence, there would not be
a need for a Department of the Army permit. Such permits are only required
if there is an unavoidable placement of fill material into a waters of the
Unitetl States, such as a stream or wetland. I hope that this memo respnds
to your concerns.
