(b) A Comparison of the proposed post mining land use to other land use in the vicinity and to
adopted state and IocaI land use plans and programs.
As stated above, all surrounding lands are currently used as rangeland with some irrigated hay
pasture above and below the proposed 39.74 acre permit area. There are currently other
gravel extraction operations within the immediate vicinity with reclamation plans for post
mining use as rangeland.
An application for a special use conditional permit for extractive an industry has been filed
with the Montrose County Land Use Department for the 39.74 acres within the proposed
permit area. The Montrose County Board of County Commissioners, Land Use Office, and
Planning Commission has previously reviewed an initial application for this site. The initial
application was withdrawn due to litigation involving the current (original site "green gate")
access.
The planned primary site access to the southeast crossing the small creek and drainage to the
west has been reviewed and approved by the US,ACOE and the county engineer. The county
approved commercial access permit to the site at this point will be issued, according to
the Montrose County Engineer, after the issuance of the County Special Use Permit. A
Settlement Agreemedt has been reached between the parties to the litigatibn concerning
this access. Copies of current application, communications and previous planning documerrts
are contained in Exhibit M. The planned site access and haul road will remain after the
completion of mining and reclamation at the site as a farm road. Future land use will be for
rangeland.
(c) A description of how the Reclamation Plan will be implemented to meet each applicable
requirement of Rule 3: Reclamation Performance Standards -Section 3.1.1 through Section
3.1.5
3.1.1 - Establishine Post-Minine Use: Post mine use will be for rangeland.
3.1.2 -Reclaiming Substituted Land: There are no previously mined lands to be substituted.
3.1.3 -Time Limit and Phased Reclamation: There will be a phased reclamation at the site.
• Phase 1 Area of 17.94 acres (west halt)
• Phase 2 Area of 16 acres. (east half)
The entire Phase l Area will be mined and reclaimed prior to moving into the Phase 2 Area.
Reclamation is planned [o fbllbw mining aciivities fairly closely. The mining (Phase I azea) will
proceed from the initial area of operations then to the southwest corner below the access road and
finally towards the Phase 2 area to the east above the access road. As such, the fmai bench areas
in the Phase I area should run along anorth/south axis along the Phase Boundary. This last bench
will be all that will require reclamation in the Phase 1 area as mining moves to the Phase 2 area.
Except for this final Phase 1 bench area, all areas of Phase i will be reclaimed prior to moving
mining activities into the Phase Z area. This final Phase I bench azea will be regraded, sloped and
reclaimed as the mining activity extends into the Phase 2 area. An approximate area of 6 acres
located south of the haul road will not be disturbed. This is a wetlands zone which wilt be
protected by silt fencing and a 50 foot buffer zone. Reclamation a[ the site will be done generally
"concurrent" with the active mining activities whenever possible. As mining proceeds from lift to
lift the "mined" upslope bench areas will be sloped and fmai graded and have topsoil placed and
seeded whenever possible. I[ is estimated that mining operations will possibly be conducted on the
site from twenty to fifty years.
