Based <br />on the information provided, it is dear that the wetland areas at Gray 1 <br />Gravel Pit are not jurisdictional under the Ct~n Water Act since they are <br />ail isolated from and not adjacent to a jurisdictional stream. The wetland <br />and spring complex at Gray 2 Gravel Pit is judsdlctlortal under the Clean <br />Water Act s{nce it is dearly tributary to a Jurisdictional stream. The <br />jurtsdictonal wetland appears to be accurately mapped, with supporting data <br />sheet documentation. <br />Since there wil! not be a fill into the jurisdictional wetland, and !f <br />will be protected from sediment loading by a silt fence, there would not be <br />a need for a Department of the Army permit. Such permits are only required <br />if ttlere is an unavoidable placemerR of fill material into a vraters of the <br />United States, such as a stream or uretiand.
