Determinations of Effect <br />Based on the above information, OSM has determined that mining and reclamation operations <br />associated with PR-02 at Colowyo Coal Company, L.P.'s Colowyo mine "may affect /likely to <br />adversely affect" the continued existence of the Colorado pikeminnow, humpback chub, <br />boneytail, and razorback sucker. Therefore, OSM is requesting the initiation of formal Section 7 <br />consultation for the net annual water depletion of 554.48 ac/ft. <br />Based on the above information, OSM has determined that mining and reclamation operations <br />associated with PR-02 at Colowyo Coal Company, L.P.'s Colowyo mine "may affect but are not <br />likely to adversely affect" the bald eagle, Canada lynx, or result in the destruction or adverse <br />modification of their critical habitats. <br />Based on the above information, OSM has determined that mining and reclamation operations <br />associated with PR-02 at Colowyo Coal Company, L.P.'s Colowyo mine will have "no effect" on <br />Mexican spotted owl, black-footed ferret, Dudley Bluffs blatterpod, and Dudley Bluffs twinpod. <br />It is also OSM's determination that current mining and reclamation activities are not likely to <br />jeopardize theYellow-billed cuckoo, Graham beazdtounge and White River beazdtounge.
