LuchheaA
Execunve Director
Michael N. long
Division Drrecbr
This is to confirm our telephone conversation that Pittsburg and Midway Coal Company's
request for an extension of the decision date for Technical Revision 37 is granted. The extension
is for 90 days (to 29 January 1998) to allow for P&M to obtain letters from the Routt County
Regional Planning Commission and the Yampa Valley Electric Company, as requested in the
Division's adequacy response to the revision.
Discussion within the Division has reconsidered comment #2 of the letter based the interpretation
of Rule 4.15.10(2) and the recognition that the electric company does, in fact, use the conveyer
condor has led us to rescind that comment. Likewise, receipt of the letter regarding water rights
for the Moffat Pond has resolved item #4 of the letter.
The 1st and 3rd items remain for resolution during the extension period.
Please feel free to call me or Larry Routten regarding these issues.
Sincerely,
Jim Burnell
Enviromnental Protection Specialist
