Nettleton (E-mail) <br />Cc: Hernandez, Dan <br />Subject: Review of Public Notice, TRs 45, 4 ,and 47, C-1962-056 <br />Dear Mr. Nettleton, the following comments are to the public notice submitted with the subject technical revision (TR) <br />applications, submitted under a Peabody Twentymile Coal Company letter dated January 17, 2005. The Division of <br />Minerals and Geology (Division) concludes that a single notice is allowed. However, please consider the following <br />changes for the reasons indicated. <br />Change 1. First paragraph, second sentence. <br />Change so much as reads "80467, has submitted a request for a Technical Revisions (TR) to the Foidel Creek Mine," <br />to read: "80467, has submitted three Technical Revision (TR) applications to the Foidel Creek Mine," <br />Reason: Three separate revision applications have been submitted. Reformatting the line to mention "applications" <br />rather than "request" uses language of the rules. <br />Change 2. Second paragraph. <br />Change the entire paragraph to read: "The permit, and supporting documentation in a Permit Application Package <br />(PAP), are on file for public review at the mine office and the office of the Colorado Division of Minerals and Geology." <br />Reason: The permit (a formal legal document, separate from the PAP), and the PAP are on file at the mine site and at <br />the Division office. These materials are not on file at the Routt County Courthouse. <br />Change 3. Fourth paragraph. <br />Change the fourth paragraph to read: "Copies of the Technical Revision Applications, less confidential material, are <br />available for inspection at the mine office, the office of the Colorado Division of Minerals and Geology, and the" (office <br />of Clerk and Recorder as indicated. <br />Reason: The revised wording identifies the locations where copies of the technical revision applications are available <br />to the public. <br />Please call me if you have any questions <br />Yours truly, Byron G.
