Aggregate Industries - W CR, Inc. <br />Amendment No.l - Jeronimus Property <br />Permit # M-1999-034 <br />to Mr. Oehler and addressed to "Vested Parties and the Mined Land Reclamation Board", we <br />discuss a variety of concerns. Section 2 of that letter discusses Bound water quality concerns <br />and ends with the following pazagraph: <br />"Upon the recommendation of the Water Quality Control Division, I request that <br />the Division of Minerals and Geology request asste-specific review of the applicant's <br />discharge permit from the Division for consideration of past, current, and potential <br />future ground-water contamination from organic chemicals attributed to historical <br />waste disposal practices at the Rocky Mountain Arsenal. Water quality monitoring, <br />on a minimum quarterly basis, of semi-volatile and volatile organic compounds <br />including D1MP should be required from mine perimeter monitoring wells, all <br />outfalls, and process water effluent. Eaceedance of regulatory ground or surface <br />water standards should require implementation of mitigation measures." <br />Unfortunately, we were unable to be present at the MLRB hearing on June 25, 2003 due to <br />previous family commitments out of state. Kazen's brother, Steve Brancucci, appeared on her <br />behalf and referenced our letter of June 3, 2003. - - - <br />We respectfully request that you reconsider your interpretation of the sampling frequency <br />requirements pertaining to Condition #2 of the MLRB Order based on the historical <br />documentation in this matter. If after review, the Division's position is that Well No. 32883 will <br />only be sampled twice, then we formally request this matter be brought before the Mined Land <br />Reclamation Boazd at the eazliest possible scheduled hearing for clazification. Please provide us <br />with any procedural information we need to act upon to bring this matter before the Board, if <br />necessary. <br />Finally as you have recommended, we will prepaze a written request to Jeff Deatherage of the <br />State Engineer's Office requesting authorization to pump the well for sampling purposes only. <br />Please feel free to contact us directly, if you have any questions or comments regarding this <br />communication. <br />Sincerely,/r /~~ <br />~~ ~ /~~ <br />Kazen & Ralf Topper <br />Cc: Hany Posey, DMG <br />
