.. <br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to approve Technical RevisionApplication No. 48 (TR-48) <br />for the Deserado Mine (Pemut No. C-81-018), submitted by Blue Mountain Energy, Inc. This revision application <br />addresses various modifications and clarifications to the approved permit with respect to the mining plan, <br />drainage control, hydrologic impact evaluation and monitoring, wildlife monitoring, topsoil and refuse cover <br />soil replacement, revegetation seedmix, revegetation success demonstration, and cultural resources survey. The <br />revision was prompted by questions raised by DMG in the most recent Mid-Term permit review. <br />The Deserado Mine is an underground coal mine located in Rio Blanco County, approximately 7 miles northeast of <br />Rangely, Colorado. Coal interest is federal, and the surface affected is federal and private land. The permit <br />azea encompasses approximately 10,829.0 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all requirements of the <br />Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, e! seq., C.R.S., and the regulations <br />promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Minerals and Geology, Room 215, Centennial Building,1313 Shem~att Street, Denver, Colorado 80203. <br />Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing <br />before the Mined Iand Reclamation Board on the proposed decision. Such request must be made within ten (] 0) days <br />of the initial publication of this notice, must be in writing, and must state with reasonable specificity the <br />reasons for the request and the objections to the proposed decision. <br />
