Long <br />Dinsion Dnecmr <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Sectiori I8, <br />Paragraph 3, of the Colorado Revised Statutes, that on May 14, 1999, an application to revise coal mining <br />operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. All review and comment <br />periods as provided in the Act and the Regulations initiate from this date of filing. <br />Approval of this petmit revision would allow the use oflongwall mining within the present permit area and at the <br />presently approved production rate of 2 million tons per year. The coal that would be extracted by the longwall <br />method is privately owned. The request for approval for longwall mining with an increase in production to 5 <br />million tons per year had originally been submitted under Technical Revision No. 7, but had been withdrawn. <br />The underground coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado. <br />The pertnit area is further described as follows: <br />Portions of Sections 2, 3, 4, 9, 10, 11, l4, 15, and 16, Township 13 South, Range 91 West of the 6th P.M. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie. <br />Because the above referenced permit revision application would incorporate additional lands into the permit area <br />or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your <br />agency's evaluation of the proposal. Your comments and concerns relating to the adequacy of fish and wildlife <br />resources information, the fish and wildlife plan, and the reclamation plan as it relates to fish and wildlife <br />considerations, including potential impacts to threatened or endangered species, are requested. Your evaluation <br />of any woody plant stocking levels, planting arrangements, and methods for mitigation of potential adverse impacts <br />is also requested. <br />A copy of the permit revision submittal cover letter and a mine permit boundary map are enclosed. In order for <br />us to comply with regulatory time frames, we request that comments be submitted to the Division of Ivtinerals and <br />Geology at the above address by 5:00 p.m. on July 13, 1999. If no comments are received by this date, we will <br />proceed on the assumption that your agency has no concerns with or objections to the applicant's proposal. <br />
