Please note that this action does not reduce <br />or substantively change your obligations as a Colorado licensee. This site was originally licensed under Part 3 <br />of the Colorado Radiation Control regulations as an "ore transfer facility" based on [he precedent of the U.S. <br />Nuclear Regulatory Commission. These materials have been regulated under Part 3 of [he Radiation Control <br />regulations, because no processing or milling of uranium ore occurred a[ [he site. <br />The Department has determined [ha[ [he disposal alternatives of [he Cotter Canon City mill site and the JD-7 <br />mine spoils pile, for the Whitewater wastes, are acceptable from [he point of view of health protection from <br />radiation. The wastes may be transferred to [he Canon City site under [he requirements of License Condition <br />(LC) 24.1 of the Cotter Whitewa[er license. The waste materials from the site may be returned to a source <br />material mine licensed under Part 3 of the Colorado Radiation Control regulations, as provided in Parts 35.4 <br />and 3.22 of the regulations, and in LC 24.1 of your Whitewater license, provided that you obtain the permission <br />of the Department of Natural Resources, Division of Minerals and Geology (DMG). Documentation of the <br />approval of the DMG needs to be supplied to the Department prior to disposal of the wastes at a DMG <br />regulated site. <br />This amendment includes changes [o your license which: <br />provide conditions for the decommissioning, decontamination and reclamation of the Whi[ewa[er site; <br />incorporates previously approved license amendments and satisfied license conditions; <br />corrects and standardizes regulatory citations which have changed; <br />
