The three referenced notices of violation (NOV) at the Raton Creek Mine are not applicable to this revision since they were issued in 1999. Rule 2.03.5 requires a listing of all NOV's received during the three year period preceding the date of this application for RN-04, the period of January 16, 2001 through January 16, 2004. All NOV's received by EFCI or other entities having common ownership in the preceding three year period aze included on revised permit pages. Revised pages are attached hereto for review and insertion into the permit application. 6. All references to the Newlin Creek Mine in Section 2.03.5 aze deleted by revision for the permit renewal. No violations were issued at the Newlin Creek Mine in the three year period preceding the application date for RN-04. In addition, reference is made to the terminated Newlin Creek Permit in above revised Section 2.03.4. Page 2.03-28 is deleted by this revision. Revised pages are attached hereto for review and insertion into the permit application. Rule 2.03.6 -Right of Entrx and O_ perational Information Response(s): 7. Pages 2.03-29 through 2.03-38 of the permit are revised to indicate the current status of EFCI's lease agreements. The only leasing changes, since those included in Permit Renewal RN-03, include the following: the Vento interests as lessors rather than Corley Mountain Ranch on the Vento property; and a supplement [o the original lease with the BN&SF Railway Co. allowing right of entry at the I,oadout for the purposes of reclamation only. Information regarding current dates for the permit expiration and renewal are revised on the appropriate permit pages.
