Approved channels and ditches need to be maintained in accordance with Rule 4.05.3(1) and the approved plan. Such repairs to channels and ditches need to be conducted immediately rather than in the late fall as proposed. Maintenance items of channels and ditches should include maintenance of grades, channel lining and revegetation. Please remove the reference of channel and ditches under the rill and gully monitoring plan. Powderhorn states that a record of the rill and gully inspections will be maintained at the mine site. Section 5.02.4(1) states that "copies of all records, reports, inspection materials, or information obtained under these Rules by the Division or Board, shall be immediately available at the Division office and at a convenient place in the area of mining to which the information pertains." Under this definition; it is necessary that the Division receive a copy of the inspection reports, maps, general description of the erosion and a description of the corrective measures to be used. The Division requires that the following items be submitted to the Division under the rill and gully monitoring plan. a. Submit by June i of each year a copy of the map identifying the rill and gully areas along with a rill and gully stabilization plan that describes the problem at each identified area. The proposed mitigation measures should also be included. b. Implement plan to be started in the summer and completed before the end of the fall planting season (date requested, please see item #4). Please incorporate the items mentioned above into the revised permit pages. 4. On page 192 of the permit, Powderhorn states that seeding and planting of disturbed areas will be conducted during the first normal period of favorable planting conditions following final preparation for seeding. Powderhorn then states that the time frame for revegetation is included in the reclamation schedule of Figure 2.05.4A. Figure 2.05.4A is vague in terms of seeding and planting. Please state in the permit text the dates in which seeding and planting will occur on disturbed areas. 5. On page 192b, Powderhorn states various correction actions to be used to repair the rills and gullies. Re-seeding the disturbed area should be noted as a corrective action and complies with Rule 4.15.1. Please include re-seeding as a corrective action in the revised permit pages.
