NOTICE OF PROPOSED DECISION
The Colorado Division of Minerals and Geology proposes that an application to
renew a valid, existing permit to conduct coal mining and reclamation
operations submitted by the Peabody Coal Co, Western Division for the Seneca
II Mine be approved with conditions.
The Seneca II operation is located in Routt County, approximately five miles
southeast of Hayden, Colorado. The mine is a surface mine with an anticipated
maximum production capacity of 600,000 tons per year. The coal to be mined is
owned by the United States, Colorado, and private parties, and the surface to
be affected is privately and state owned. The legal descripton of the permit

This proposed approval decision is based on a finding that the proposed
operation will comply with all requirements of the Colorado Surface Coal
Mining Reclamation Act, C.R.S. 34-33-101, et seq., and the regulations
promulgated thereunder.
Copies of the proposed decision including stipulations, are on file for public
inspection at the Colorado Division of Minerals and Geology, Room 215,
Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the
County Clerk's Office, at the County Courthouse in Steamboat Springs, CO.
Persons with an interest that may be adversely affected by the proposed
decision may request a formal hearing before the Mined Land Reclamation Board
on the proposed decision. Such request must be made within thirty (30) days
of the initial publication of this notice, must be in writing, and must state
with reasonable specificity the reasons for the request and the objections to
the proposed decision.
